TimeStamp Pro Terms & Conditions

By downloading, installing, or using TimeStamp Pro (“the app”, “we”, “our”), you (“you”, “the user”) agree to these Terms & Conditions (“Terms”). If you do not agree, please do not use the app. These Terms, together with our Privacy Policy, form the complete agreement between you and WebNovaHub.

1. Eligibility

• You must be at least 13 years old, or the age of digital consent in your country (16 in most of the EU), to use the app.
• If you are under the age of majority in your jurisdiction, a parent or legal guardian must agree to these Terms on your behalf.
• You confirm that you have the legal capacity to enter into a binding agreement.

2. Use of the App

• You may use the app for personal and lawful commercial purposes.
• You are responsible for the accuracy and use of all data captured (location, timestamp, weather, address, etc.).
• You are responsible for complying with all laws applicable to you when capturing photos, videos, audio, and location data.

3. Prohibited Conduct

You agree NOT to use TimeStamp Pro to:

• Harass, stalk, surveil, or intimidate any person.
• Capture photos, videos, or audio of others without consent where consent is required by law.
• Fabricate, forge, or falsify timestamps, locations, addresses, or weather data for fraudulent purposes.
• Submit stamped content as evidence in legal, insurance, or regulatory proceedings without disclosing that the stamps were generated by a consumer mobile app.
• Reverse engineer, decompile, disassemble, or attempt to bypass tamper-detection or authenticity features of the app.
• Violate any third party’s privacy, intellectual property, publicity, or other rights.
• Distribute malware, automated scripts, or scraping tools targeting the app or its services.
• Use the app in any jurisdiction where doing so is illegal.

4. Evidentiary Use Disclaimer

• TimeStamp Pro stamps are intended as informal time, location, and condition markers. They are not certified as legal, forensic, or evidentiary records.
• Admissibility of stamped photos, videos, or data in any court, tribunal, insurance claim, regulatory proceeding, or contractual dispute is at the sole discretion of the relevant authority or counterparty.
• We make no representation or warranty that stamps will be accepted as proof in any proceeding.
• GPS, NTP time sync, and tamper-evident features are best-effort technical measures, not guarantees of authenticity.
• If your work, insurance, or compliance requires certified evidence, you should use a service specifically certified for that purpose. TimeStamp Pro is not such a service.

5. User Content & Ownership

• You retain full ownership of all photos, videos, audio, and content you capture or create using the app.
• We do not claim any license, ownership, or rights over your content.
• Custom text, logos, and templates you add to stamps must not infringe any third party’s copyright, trademark, or other rights. You are solely responsible for the content of any logo or text you upload.
• If you enable optional cloud sync of stamp settings and templates (Pro), you grant us a limited, revocable, non-exclusive license solely to store and sync those settings across your devices. We do not use them for any other purpose.

6. Data & Privacy

• Your use of the app is also governed by our Privacy Policy.
• Photos and videos remain on your device unless you choose to share them.
• Limited pseudonymized data is processed by third-party services (analytics, ads, geocoding, weather) as described in the Privacy Policy.

7. Third-Party Services

These services operate under their own terms and privacy policies, which you should review. We are not responsible for the availability, accuracy, or behaviour of third-party services, or for any changes those providers make.

8. Advertisements

• The Free version of the app displays banner ads served by Google AdMob.
• AdMob may use device identifiers (such as the Advertising ID), IP address, and app interaction data to deliver, cap, and measure ads, in accordance with Google’s policies.
• You can opt out of personalised ads in your device’s Ad Settings.
• You can remove banner ads by upgrading to the Pro subscription.

9. Pro Subscription

Pro features (including Maximum Accuracy address mode, ad removal, custom stamp builder, and optional cloud sync) are available via a paid auto-renewing subscription processed through Google Play Billing.

10. Refunds & Consumer Rights

• Refunds for in-app subscriptions are processed by Google Play under Google Play’s refund policy. Submit refund requests through your Google Play account.
• EU / EEA / UK consumers: You have a 14-day right of withdrawal under the EU Consumer Rights Directive (and equivalent UK law). You acknowledge that by starting to use Pro features immediately upon subscribing, you may be deemed to have given express consent to begin performance and to have waived the right of withdrawal for digital content already supplied, where applicable.
• Canadian consumers: Nothing in these Terms limits your statutory rights under the Ontario Consumer Protection Act or other applicable provincial consumer protection legislation.
• Statutory consumer rights in your jurisdiction apply regardless of anything in these Terms and cannot be waived.

11. Intellectual Property

• The app, its source code, design, branding, name, logo, and all features are the property of WebNovaHub and are protected by copyright, trademark, and other intellectual property laws.
• We grant you a limited, non-exclusive, non-transferable, revocable licence to use the app for its intended purpose on devices you own or control.
• You may not copy, modify, reverse engineer, decompile, disassemble, sublicense, rent, lease, or redistribute the app or any portion of it, except to the extent such restrictions are expressly prohibited by applicable law.

12. Accuracy Disclaimer

• Location, time, address, weather, and sensor data may not always be accurate. Accuracy depends on device hardware, GPS signal, network conditions, and third-party data providers.
• The app is provided as a tool to assist documentation, not as a precision instrument.
• We are not responsible for inaccuracies in GPS, NTP time sync, geocoded addresses, weather data, or any decision you make in reliance on stamped data.

13. Warranty Disclaimer

TO THE FULLEST EXTENT PERMITTED BY LAW, the app is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the foregoing exclusions apply only to the extent permitted by law.

You agree to indemnify and hold harmless WebNovaHub and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of: (a) your misuse of the app; (b) your violation of these Terms; (c) your violation of any third party’s rights, including privacy or intellectual property rights; or (d) any content you create, capture, or distribute using the app.

16. Termination

• We may suspend or terminate your access to the app or any Pro features if you violate these Terms or misuse the app.
• You may stop using the app at any time by uninstalling it. Cancelling a Pro subscription is handled via Google Play (Section 9).
• Sections 4, 5, 11, 13, 14, 15, 17, and 18 survive termination.

17. Governing Law & Jurisdiction

• These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles.
• Subject to mandatory consumer protection laws in your country, you and we agree that the courts of Ontario, Canada have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the app.
• Consumer carve-out: If you are a consumer resident in the EU, EEA, UK, or another jurisdiction with mandatory consumer protection laws, you retain the protection of the mandatory provisions of the law of your country of habitual residence, and you may bring proceedings in the courts of your country of residence.

18. Force Majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government action, internet outages, third-party service disruptions, or failures of GPS or telecommunications infrastructure.

19. Severability

If any provision of these Terms is held invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or, if not possible, severed. The remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms, together with the Privacy Policy and any in-app disclosures presented at the time of subscription, constitute the entire agreement between you and WebNovaHub regarding the app, and supersede any prior agreements or understandings.

21. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date at the top reflects the most recent revision. Material changes will be highlighted in the app on next launch. Your continued use of the app after changes take effect constitutes acceptance of the revised Terms.
